What to bring to the notary for an occasional lease?
Three documents required when concluding the agreement
- The tenant's declaration in the form of a notarial deed. In it you submit to enforcement and undertake to vacate the premises within the period given in the landlord's request (art. 19a para. 2 point 1; art. 777 § 1 point 4 of the Code of Civil Procedure).
- The designation of replacement premises where you can live after enforcement (point 2). It is an ordinary written declaration.
- The declaration of the owner of the replacement premises consenting to you and the people living with you living there (point 3). The signature must be certified by a notary if the landlord requires it.
Checklist for the visit to the notary
- a valid identity document (ID card or passport),
- a printed, completed tenant's declaration and a draft of the deed (we prepare them from the data in the form),
- the address of the replacement premises and the details of its owner or a person with a legal title, together with the land and mortgage register number,
- the details of the rented premises and the landlord (for the agreement and the deadline for vacating the premises),
- if you do not speak Polish: a sworn translator, unless you have agreed otherwise with the law office,
- funds for the notarial fee and copies; we describe the fee limit in the guide on costs.
After signing
You hand the deed (a copy) and the other documents to the landlord, who attaches them to the agreement. The agreement and its amendments require written form, otherwise they are void. The landlord reports the lease to the tax office within 14 days of the start of the lease.
Frequently asked questions
Do I have to go to the notary in person?
You make the declaration in the form of a notarial deed at the notary in person or through a duly authorised attorney, if the notary allows it. Ask the law office.
Does the landlord have to be at the notary?
No. The tenant is needed for the deed. The landlord receives a copy and attaches it to the agreement.
How much time do I have to vacate the premises after the request?
The landlord states the period in the request, no shorter than 7 days. It is taken into account in the notarial deed in which the tenant undertakes to do so.
