Frequently asked questions.
What is an occasional lease?
It is a residential lease concluded for a fixed term of no more than 10 years, regulated by art. 19a of the Act on the protection of tenants' rights. Thanks to it the landlord can recover the premises more easily, because the tenant submits to enforcement in a notarial deed and designates premises where they can live after eviction. The agreement must be in writing, otherwise it is void.
What is the replacement address (replacement premises)?
It is premises where the tenant can live if, after the lease expires or is terminated, an obligation to vacate the premises is enforced. The tenant designates it in the declaration and attaches the consent of the owner of those premises (art. 19a para. 2 points 2 and 3).
What documents are needed for an occasional lease?
Three: (1) the tenant's declaration designating the replacement premises, in ordinary written form; (2) the declaration of the owner of those premises consenting to the tenant living there, ordinary or with the signature certified by a notary if the landlord requires it; (3) a notarial deed in which the tenant submits to enforcement (art. 777 § 1 point 4 of the Code of Civil Procedure) and undertakes to vacate the premises within the period given in the landlord's request, no shorter than 7 days.
Do I have to have the owner's signature certified by a notary?
Only if the landlord requires it. In practice many landlords do, so the version with certification is safer when you are not sure.
Who gives consent to live in the replacement premises?
The premises are rented by the company from their owner, who agreed to make them available to persons designated by the company. The consent is given by the company as an entity with a legal title to the premises (art. 19a para. 2 point 3). In the document we state the basis of the title and the land and mortgage register number.
How long does it take and how will I get the document?
Usually 1–2 working days from the order. You get a PDF by e-mail, and you can collect the original at the law office in Warsaw, receive it by parcel locker or by courier. With the Express option (+100 PLN) a member of the law office puts the original into a parcel locker in the office building, and we send the pickup code by SMS and e-mail.
How much does the tenant's notarial deed cost?
The notarial fee for this deed cannot exceed 1/10 of the minimum wage (art. 19a para. 7 of the Act). VAT and fees for copies are added. The law office will give the exact amount.
Can a foreigner use the service?
Yes. The form is in Polish, English, Ukrainian, Russian, Belarusian and Georgian, and the documents are drawn up in Polish. If you do not speak Polish, the notary may require the presence of a sworn translator, so it is worth agreeing this with the law office before the visit.
What if I lose the ability to live in the designated premises?
You have 21 days to designate other premises together with the consent of their owner (art. 19a para. 3). If you do not, the landlord can terminate the agreement with a notice period of at least 7 days.
